Statutes of Limitations

Time limits apply. Financial elder abuse claims carry a longer window under Welfare and Institutions Code §15657.7: four years from the date the plaintiff discovers, or through reasonable diligence should have discovered, the facts constituting the financial abuse. When abuse was concealed or a resident was cognitively impaired and unable to report what happened, California’s discovery rule may delay the start of that period. If a resident died as a result of abuse or neglect, the estate may bring a survival action, and eligible heirs may file a wrongful death claim, generally within two years of the date of death.

Filing a Complaint & Pursuing a Civil Claim
